This Privacy Policy sets out the rules for the processing of personal data by Sarapata Art Gallery, obtained through this website www.sarapataartgallery.com (hereinafter: "Sarapata Art Gallery").

Personal data collected by Sarapata Art Gallery through this website is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), also known as the TODO.

§ 1 Type of data processed, purposes and legal basis

Sarapata Art Gallery collects information on natural persons performing a legal action not directly related to their activities, natural persons conducting business or professional activities on their own behalf, and natural persons representing legal persons or organizational units that are not legal persons, to which the law grants legal capacity, hereinafter collectively referred to as Customers.

  2. Customers' personal data are collected in the event of:

    1. placing an order in the Online Store, in order to execute the sales contract. Legal basis: necessary for the execution of the sales contract (Article 6(1)(b) RODO);

    2. subscribing to a newsletter (Newsletter), for the purpose of executing a contract the subject of which is a service provided electronically. Legal basis - consent of the data subject to perform the contract for the Newsletter service (Article 6(1)(a) RODO);

    3. Use of the contact form service on the website for the performance of the contract for the service provided electronically. Legal basis: necessary for the performance of the contract for the provision of the contact form service (Article 6(1)(b) RODO).

  3. When placing an order on the Online Store, the Customer provides the following data:

    1. e-mail address;

    2. address data

      1. postal code and city;

      2. country (state);

      3. street along with house/apartment number

    3. first and last name;

    4. telephone number.

  4. In the case of Entrepreneurs, the above data scope is further expanded to include:

    1. company name;

    2. NIP number

  5. In the case of using the Newsletter service, the Customer provides the following data:

    1. e-mail address

    2. first and last name.

  6. In case of using the contact form, the Customer provides the following data::

    1. e-mail address;

    2. first and last name.

  7. When using the Sarapata Art Gallery Website, additional information may be collected, in particular: the IP address assigned to the Customer's computer or the external IP address of the Internet provider, domain name, browser type, access time, type of operating system.

  8. Navigation data may also be collected from Customers, including information about the links and references they choose to click on or other actions they take on the Online Store. Legal basis - legitimate interest (Article 6(1)(f) RODO) to facilitate the use of services provided electronically and to improve the functionality of such services.

  9. For the purpose of establishing, investigating and enforcing claims, certain personal data provided by the Customer in the course of using the functionality on the Online Store may be processed, such as name, surname, data on the use of the services, if the claims arise from the manner in which the Customer uses the services, other data necessary to prove the existence of the claim, including the extent of the damage suffered. Legal basis - legitimate interest (Article 6(1)(f) RODO), consisting in the establishment, investigation and enforcement of claims and defense against claims in proceedings before courts and other state authorities.

Provision of personal data to Sarapata Art Gallery is voluntary, in connection with contracts of sale or provision of services through the Sarapata Art Gallery Website, with the proviso, however, that failure to provide the data specified in the forms in the process of placing an order will prevent the placement and execution of the Customer's order.

  2. Personal data of the Clients are collected in case:

    1. placing an order in the Online Shop, in order to perform a sales contract. Legal basis: indispensability for the performance of a sales contract (Article 6(1)(b) of the TALIA);

    2. subscription to a newsletter (Newsletter), in order to perform an agreement whose subject matter is a service provided electronically. Legal basis - the data subject's consent to the performance of the Newsletter service agreement (Article 6.1.a of the PCO);

    3. the use of the service of a contact form on the website for the purpose of performing a contract provided by electronic means. Legal basis: indispensability of the contact form service contract (Article 6.1.b of the PCO).

  3. When placing an order in the Online Shop, the Customer provides the following data:

    1. e-mail address;

    2. address data:

      1. postal code and town;

      2. country (country);

  4. street with house/apartment number.

  5. First and last name;

  6. telephone number.

  7. In the case of Entrepreneurs, the above scope of data is further extended by:

  8. the company of the Entrepreneur;

  9. NIP number.

  10. In case of using the Newsletter service, the Client provides the following data:

  13. In case of using the contact form service, the Client provides the following data:

  16. When using the Sarapata Art Gallery website, additional information may be collected, in particular: IP address assigned to the Client's computer or external IP address of the Internet provider, domain name, browser type, access time, operating system type.

  17. Customers may also collect navigational data, including information about the links and links they choose to click on or other actions taken in the Online Shop. Legal basis - a legally justified interest (Article 6(1)(f) of the TABLE), consisting in facilitating the use of services provided electronically and improving the functionality of these services.

  18. In order to determine, pursue and enforce claims, certain personal data provided by the Customer as part of using the functionality of the Online Shop may be processed, such as: name, surname, data concerning the use of services, if the claims result from the way the Customer uses the services, other data necessary to prove the existence of the claim, including the extent of damage suffered. Providing personal data to Sarapata Art Gallery is voluntary, in connection with concluded contracts of sale or provision of services via the Sarapata Art Gallery website, with the reservation, however, that failure to provide the data specified in the forms in the process of placing an order will make it impossible to place and execute the Customer's order.

§ 2 To whom is the data shared or entrusted and how long is it kept?

  1. Customer's personal data are transferred to the service providers used by Sarapata Art Gallery in the operation of the Online Store. The service providers to whom personal data is transferred, depending on contractual arrangements and circumstances, are either subject to Sarapata Art Gallery's instructions as to the purposes and means of processing such data (processors) or determine the purposes and means of processing themselves (controllers).

    1. Processors. Sarapata Art Gallery uses vendors who process personal data only at the direction of Sarapata Art Gallery. These include, but are not limited to, providers of hosting services, accounting services, providers of marketing systems, systems for analyzing traffic to the Online Store, systems for analyzing the effectiveness of marketing campaigns;

  3. Customers' personal data are stored:

    1. If the basis for the processing of personal data is consent then the Customer's personal data is processed by Sarapata Art Gallery as long as the consent is not revoked, and after the revocation of consent for a period of time corresponding to the period of limitation of claims that Sarapata Art Gallery may raise and that may be raised against it. Unless a specific provision provides otherwise, the statute of limitations is six years, and for claims for periodic benefits and claims related to the conduct of business - three years.

    2. If the basis for data processing is the performance of the contract, then the customer's personal data are processed by Sarapata Art Gallery for as long as it is necessary to perform the contract, and after that for a period corresponding to the period of limitation of claims. Unless a special provision provides otherwise, the statute of limitations is six years, and for claims for periodic benefits and claims related to the conduct of business - three years.

  4. If you make a purchase from the Online Store, your personal data may be transferred to a courier company for delivery of the ordered goods.

  5. If the Customer chooses to make a payment through PayPal or PayU Poland, his/her personal data is transferred to the extent necessary for the payment to the above-mentioned companies.

  6. In the event that the customer subscribes to the newsletter (Newsletter) to his e-mail address Sarapata Art Gallery will send electronic messages containing commercial information about promotions and new products available on the site Sarapata Art Gallery.

§ 3 Cookies mechanism, IP address
